If the capital connected to the shares of the company has been used and if recklessness against third-party can be shown certain legal actions may also be used,” said Rolf Åbjörnsson, lawyer and expert in bankruptcy issues.
Another legal definition that could be applicable is if Saab has made deals with some suppliers but not with others while the company has been in a unhealthy situation. (note to clarify: in Sweden according to the law, invoices needs to be payed as they arrive, in that order, a company can not pick out the ones they only want/can pay. They need to be payed in the right order).
